Telework is governed by the framework directive and other directives that govern working conditions at the European level, such as the Working Time Directive and occupational safety and health (OSH).
FREMONT, CA: The framework directive as well as other directives that regulate working conditions at the European level, such as the Working Time Directive and the Occupational Safety and Health Directive, apply to telework (OSH). Despite this, there isn't a single piece of legislation in the EU that specifically addresses telecom work. Instead, it is controlled at the federal level by statutory law, social discussion, and collective bargaining.
However, the EU Framework Agreement on Telework, an independent agreement between social partners drafted in 2002, is at the core of the European approach to teleworking. According to the document, telework is a form of organising and/or performing work, utilising information technology, in the context of an employment contract/relationship, where work is regularly conducted away from the employer's premises, even though the work might also be completed there. Additionally, it provides a concise, albeit broad, explanation of businesses' obligations toward teleworkers before a pandemic.

These responsibilities include ensuring that the teleworker benefits from the same rights as on-site workers, while also taking into account the particularities of teleworking. It also underlines the fact that the employer is responsible for the teleworkers’ occupational safety and health, especially when it comes to working conditions and the use of tools. The agreement makes it clear that teleworkers are entitled to request inspection visits to ensure that their working space is fit for purpose and ergonomic. It also establishes basic rules around aspects such as work organisation, training, data privacy and equipment.
Even though the debate over the right to work from home has been gaining momentum for some time, with nations like France introducing a legal right to disconnect in 2016, the COVID-19 pandemic and the subsequent wave of teleworking prompted a review and tightening of teleworking regulations. Five nations—Italy, Luxembourg, Latvia, Slovakia, and Spain—had changed their laws by March 2021, while several more—including Austria, Belgium, Cyprus, Croatia, Hungary, Ireland, Germany, Malta, Poland, Portugal, and Slovenia—were evaluating their domestic laws. The Flexible Working Act was being evaluated legally in the Netherlands; therefore, this examination also took into account modifications to the teleworking regulations brought on by the pandemic's circumstances.
These accepted or suggested telework-related national regulations modifications can be divided into four major categories: The ability to maintain a healthy work-life balance while engaging in telework is included in the legal definition of telework. Specific OSH provisions, such as the obligation of the employer to ensure that the teleworking station is ergonomic and helps to prevent the development or aggravation of a musculoskeletal disorder, are also included in this definition (MSD).
Although there are many similarities among the teleworking laws in Europe, such as the right of the employee to work remotely safely and healthily and the right to disconnect at the end of the workday, companies should check the teleworking laws in their own country for more detailed national advice.
